Illinois’ temp employee equal pay and advantages calculation will get delay to April 1, 2024

Implementation of the equal pay and advantages provision of Illinois’ Day and Non permanent Labor Companies Act was delayed below laws authorized Nov. 9 by the Illinois Legislature.

The unique Day and Non permanent Labor Companies Act mandated staffing companies to offer contingent workers, after 90 days of labor, with equal pay and advantages as employees employed instantly by the shopper firm. Accredited Nov. 9, the brand new invoice, known as HB 3641, delays the beginning of the 90-day calculation interval till April 1, 2024.

The delay will present extra time for the state to draft rules that can be clear, Toby Malara, VP of presidency relations on the American Staffing Affiliation, stated in an interview with SIA.

“A part of the issue is these proposed guidelines have been very obscure about what the advantages have been that needed to be included within the calculation,” Malara stated. “This offers the Division of Labor in Illinois extra time to write down their guidelines and provides extra steering.”

It’s hoped the additional time will give the Illinois Division of Labor time to draft guidelines that work for everyone, he stated.

The delay within the implementation of the 90-day calculation interval was handed on the urging of the ASA, the Staffing Companies Affiliation of Illinois and the Illinois Search and Staffing Affiliation.
